Part I – Provisions common to all activities

Article 1 – Service provider

These general terms and conditions (the “Terms”) are offered by NAVI, a French simplified joint-stock company (société par actions simplifiée) with a share capital of €1,000, registered with the Marseille Trade and Companies Register under number 922 478 961 (SIRET 922 478 961 00019), whose registered office is at 201 rue Paradis, 13006 Marseille, France, and which operates the LOCVOILIER brand from its nautical base at the Port Corbières harbour office, Quai de la Lave, 13016 Marseille, France (“LOCVOILIER”). Contact: contact@locvoilier.com – +33 7 44 90 91 83 (phone and WhatsApp) – www.locvoilier.com.

LOCVOILIER is the Client’s sole point of contact and is solely responsible for the service towards the Client, including where it uses partners (boat owner or manager, skipper company, seagoing staff, caterers and suppliers).

Where a specific agreement (rental, charter management or service agreement) names another entity operating the LOCVOILIER brand as the contracting party, that entity is the provider within the meaning of these Terms, which apply between it and its counterparty.

Article 2 – Activities covered, contract documents and acceptance

These Terms apply to all LOCVOILIER services and sales: (A) private skippered boat trips; (B) boat rental, without a skipper (“bareboat”) or with a skipper; (C) yacht delivery; (D) sea transfers of passengers; (E) the sale of products and gift vouchers, online or in person; (F) catering and drinks, provided directly or by partner caterers; (G) the provision of seagoing staff (professional skipper, deckhand, host, onboard cook); (H) charter management and technical management of boats entrusted by their owners; (I) à la carte services offered to boat owners (check-in, check-out, cleaning, seagoing staff); and related services (equipment, options).

The matching of owners and renters offered on the locvoilier.com platform, where the owner manages the rental of their boat themselves (“self-managed”), is not a service sold by LOCVOILIER under these Terms: it is governed by the platform terms of use, and the rental contract is then concluded directly between the owner and the renter. Services that LOCVOILIER itself sells on that occasion (Part II-I) remain subject to these Terms.

Part I applies to all activities. Part II sets out the conditions specific to each activity and prevails over Part I for the activity concerned.

The contract documents are, in decreasing order of priority: the signed rental, charter management or service agreement and the condition report; the quote, order or booking confirmation (date, times, boat, number of people, included services, price, security deposit amount); Part II; Part I.

The Terms are provided to the Client before the contract is concluded, attached to the quote or confirmation, and available at www.locvoilier.com. The Client’s written confirmation of the booking, payment of all or part of the price, signature of the agreement or boarding constitutes full acceptance of these Terms.

Article 3 – Booking and payment by a third party

The booking is firm upon receipt of the requested payment (deposit or full amount) and LOCVOILIER’s written confirmation by email or WhatsApp.

Where the booking or payment is made by someone other than the beneficiaries of the service (assistant, company, relative), the payer and the cardholder declare that they act with their consent, accept these Terms on their behalf and guarantee compliance with them. A payment may not be disputed on the ground that it was made on behalf of a third party.

Article 4 – Prices

Prices are in euros, all taxes included.

What the price includes is set out in the quote and, failing that, in Part II for each activity. Services not included and ordered on the spot (towels, additional drinks or bottles from the à la carte selection, other extras) are paid on the spot, in cash or by any other accepted means, at the price given before they are ordered.

The price is the same whatever the payment method. LOCVOILIER may grant a discount for payment by bank transfer, provided it is announced before payment.

Article 5 – Payment terms

Unless otherwise agreed or provided in Part II (in particular Articles E2 and H9): a 50% deposit is due at booking and the balance no later than 7 days before the service starts. For any booking made less than 7 days before, the full price is due at booking. If the balance is not paid by the deadline, LOCVOILIER may treat the booking as cancelled by the Client, and the cancellation scale of the activity concerned applies.

Accepted methods: bank transfer; card (including American Express) through LOCVOILIER’s secure payment page, operated by Stripe with strong customer authentication (3-D Secure) where offered by the issuer. Payments are denominated and charged in euros; any currency conversion is carried out by the card issuer under its own terms, at the cardholder’s expense.

Card payments appear on the cardholder’s statement as “LOCVOILIER”. An electronic receipt is sent to the payer. The security deposit required for rentals is governed by Article B4.

Article 6 – Right of withdrawal

Under article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to catering, leisure and transport-of-goods services that must be provided on a specific date or during a specific period. Boat trips, pleasure-boat rentals, yacht deliveries, catering and crew services booked for a specific date or period therefore carry no right of withdrawal. Passenger transfers are also covered by the exclusion for passenger transport services (article L221-2, 9° of the same code).

A consumer Client does, however, have a 14-day right of withdrawal under articles L221-18 et seq. of the French Consumer Code: for products bought at a distance (Article E5); for gift vouchers bought at a distance (Article E7); and for charter management or technical management agreements concluded at a distance or off-premises (Article H11). The model withdrawal form is set out in Article 17.

Outside these cases, cancellation by the Client is governed exclusively by Article 7 and by the cancellation scale of the activity concerned.

Article 7 – Cancellation or postponement by the Client

Any cancellation must be notified in writing (email to contact@locvoilier.com or WhatsApp message to the number given in Article 1). The date of receipt applies. Amounts paid are retained or refunded according to the scale of the activity concerned (Articles A2, B11, C6, D5, F6 and G7). These amounts reflect the costs incurred and the impossibility of reselling the booked period.

The Client may request to postpone the service once, no later than 7 days before the scheduled date (30 days for a rental of 3 days or more), subject to availability; amounts paid are then carried over to the new date.

Conversely, if LOCVOILIER cancels the service for a reason other than weather, safety or force majeure (Articles 8 and 9), the Client receives a full refund plus compensation equal to the amount the Client would have borne had the Client cancelled on the same date.

Article 8 – Weather and safety

The safety of people and of the boat takes precedence over any other consideration. The skipper in command (LOCVOILIER’s skipper, or the renter in a bareboat rental) decides on departure, itinerary and return to port according to the weather, sea state, decisions of the authorities and regulations, in particular those of the Calanques National Park, which strictly govern anchoring and swimming.

Where LOCVOILIER cancels or postpones a service before it starts for weather or safety reasons, it informs the Client as early as possible. The Client then chooses between a free postponement, subject to availability, and a refund of the amounts paid for the part not performed, within 14 days. The conditions specific to each activity (interruption during the service, rental days on which sailing is not possible) are set out in Part II.

The Client’s mere wish not to sail, where LOCVOILIER has neither cancelled nor prohibited the trip, is not a cancellation for weather reasons and falls under the cancellation scale.

Article 9 – Force majeure

Neither party is liable for failure to perform its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code. In that case, LOCVOILIER offers a postponement or, failing agreement, refunds the amounts paid for the service not provided.

Article 10 – Liability and insurance

The boats are operated in accordance with the regulations applicable to their category and covered by third-party liability insurance. LOCVOILIER is liable for the proper performance of its services under ordinary law; it is not liable for damage resulting from the act of the Client, of the persons in the Client’s care, of a third party, or from force majeure.

The Client is liable for damage caused to the boat, its equipment or third parties by the Client and by the persons in the Client’s care. Personal belongings remain in the care of their owners; LOCVOILIER is liable for them only in the event of proven fault.

The Client alone is responsible for meeting their own time constraints (train, flight, cruise ship). LOCVOILIER endeavours to take them into account where notified in writing, but cannot be held liable for a delay caused by the weather, force majeure, the Client or a third party.

Article 11 – Evidence

The parties agree, in accordance with article 1368 of the French Civil Code, that the following constitute valid and enforceable evidence: email and WhatsApp exchanges, quotes and confirmations, signed agreements and condition reports, including electronically signed ones, records of the payment provider (Stripe), the logbook, engine hour readings, the boat’s positioning data (GPS/AIS) and time-stamped photographs or videos taken at departure, on return or during an incident.

Article 12 – Complaints and payment disputes

Any complaint must be sent in writing to contact@locvoilier.com within 8 days after the end of the service, stating the facts complained of. LOCVOILIER undertakes to reply within 15 days and to seek an amicable solution. This time limit does not restrict the statutory guarantees enjoyed by consumers for products sold (Article E6).

The Client undertakes to contact LOCVOILIER before taking any action with the card issuer. In the event of a payment dispute (“chargeback”) concerning a service performed or cancelled in accordance with these Terms, or a deduction from the security deposit made in accordance with Article B4, LOCVOILIER will provide the card issuer with the relevant supporting documents (accepted Terms, confirmation, agreement, condition reports, photographs, repair quotes or invoices, exchanges) and reserves the right to recover the amounts due and any dispute fees charged to it.

Article 13 – Business clients

Where the Client acts for business purposes, invoices are payable on the date stated; any late payment automatically incurs penalties at three times the French statutory interest rate and a fixed recovery fee of €40 (article L441-10 of the French Commercial Code). Any dispute with a business Client falls within the exclusive jurisdiction of the courts of Marseille.

Article 14 – Consumer mediation

In accordance with articles L611-1 et seq. of the French Consumer Code, a consumer Client may, free of charge and after a prior written complaint that has not been resolved, refer the matter to the consumer mediator LOCVOILIER is registered with: CM2C – Centre de la médiation de la consommation de conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris, France – declarer-un-litige@cm2c.net – www.cm2c.net (online filing).

Article 15 – Personal data

The data collected (identity and contact details of clients and passengers, the skipper-in-command’s sailing documents, booking and payment information) are processed by LOCVOILIER to manage bookings, ensure safety on board and comply with its legal obligations. They are kept for as long as necessary for these purposes and the statutory limitation periods. Card data are processed exclusively by Stripe and are not stored by LOCVOILIER. The Client has the right to access, rectify, erase and object by writing to contact@locvoilier.com, and may lodge a complaint with the CNIL (French data protection authority).

Article 16 – Governing law and language

These Terms are governed by French law. In the event of a dispute with a consumer, and failing an amicable solution, the competent courts are determined under the ordinary rules; a consumer retains the protection afforded by the mandatory provisions of their country of residence.

These Terms are drawn up in French and English. In the event of any discrepancy, the French version prevails.

Article 17 – Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract, in the cases provided for in Article 6.)

Part II-A – Private skippered boat trips

Article A1 – Service, times and itinerary

Unless otherwise stated in the quote, the price includes private use of the boat, a professional skipper, fuel, port charges and, where applicable, transfer of the boat to the agreed boarding port. Catering and drinks are included only where expressly listed in the quote.

Guests must be at the meeting point 15 minutes before departure. If the Client is late, the trip is not extended: the scheduled return time is kept and no refund is due. Without news from the Client more than 60 minutes after the scheduled time, the trip is treated as cancelled by the Client (no-show).

The itinerary and swimming spots provided are indicative. Their adaptation by the skipper does not constitute a failure to perform the contract and gives no right to a refund.

Article A2 – Cancellation scale (boat trips)

  • more than 30 days before the trip: full refund of the amounts paid, less any payment fees not returned by the payment provider;
  • 30 to 15 days before the trip: 50% of the total price remains due to LOCVOILIER;
  • less than 15 days before the trip, or no-show: 100% of the total price remains due to LOCVOILIER.

Article A3 – Interruption of the trip

In the event of an interruption after departure for weather or safety reasons not attributable to the Client: if less than half of the scheduled duration has been completed, 50% of the sailing price (excluding catering consumed) is refunded; beyond that, no refund is due. An interruption caused by a guest’s behaviour gives rise to no refund.

Article A4 – Catering and drinks

Where catering is included, the menu is set out in the confirmation. Part II-F (orders, allergens, alcoholic drinks, cancellation) applies.

Article A5 – Rules on board

Guests comply with the safety instructions and directions of the skipper, who has authority on board. The number of guests may not exceed that stated in the confirmation.

Swimming, snorkelling and paddleboarding take place only at the times and in the areas authorised by the skipper, under the responsibility of each guest, who declares that they can swim and are in suitable physical condition. Minors remain under the supervision of the adults accompanying them.

Guests go barefoot on board. The following are prohibited: illegal substances, dangerous behaviour and any conduct likely to disturb the safety or peace of the trip. The skipper may refuse boarding or end the trip, without refund, in the event of a serious breach or endangerment.

Part II-B – Boat rental, bareboat or with a skipper

Article B1 – Purpose and rental documents

The rental covers the provision of the boat named in the agreement, with its safety equipment and inventory, for the period, sailing area and maximum number of people stated in the agreement.

Each rental gives rise to a rental agreement and to a condition and inventory report drawn up at departure (check-in) and on return (check-out). The agreement specifies in particular the daily rental price, the security deposit, the insurance excess, the handover and return times and, where applicable, the cleaning fee.

Unless otherwise stated, the price includes the provision of the boat, its statutory safety equipment and the boat’s insurance within the limit of the excess. It does not include fuel consumed, port charges at ports of call, provisioning, or a skipper for a bareboat rental.

Article B2 – Skipper in command and qualifications (bareboat rental)

The renter appoints a skipper in command, named in the agreement, who must be of age and hold the certificates required by regulations for the rented boat (in particular the French pleasure-boat licence, or an equivalent, for a motorboat). The skipper in command declares that they have the experience needed to handle the boat in the planned sailing area and provides LOCVOILIER, on request, with their certificates, an identity document and a sailing résumé.

LOCVOILIER may, before departure or at check-in, check the skipper in command’s competence through a short sail. If it considers, on reasoned grounds, that this competence is insufficient for safety, LOCVOILIER may refuse to hand over the boat or make the handover conditional on a skipper being on board at the renter’s expense. In the event of refusal, the renter is refunded the amounts paid, less costs incurred, unless the renter made a false declaration.

The skipper in command is responsible for handling the boat, for the safety of the people on board and for compliance with maritime and port regulations. They may only entrust the helm to a person with the same qualifications.

Article B3 – Handover (check-in)

The boat is handed over at the port and time stated in the agreement, seaworthy, clean, with a full fuel tank and the safety equipment corresponding to its category. Check-in includes a presentation of the boat and its equipment, a safety briefing and a joint condition and inventory report, signed by both parties and supplemented by time-stamped photographs.

The renter must report any apparent defect or damage at check-in. Unless reservations are recorded on the report, the boat is deemed to have been handed over in good condition and in accordance with the inventory.

Handover is subject to full payment of the price, provision of the security deposit (Article B4) and delivery of the documents requested from the skipper in command. A late arrival of the renter at handover does not extend the rental.

Article B4 – Security deposit

A security deposit, whose amount is set in the agreement according to the boat, is provided no later than at check-in, by a card pre-authorisation (hold without charge) on LOCVOILIER’s secure page (caution.locvoilier.com) or by any other means provided in the agreement. As a card authorisation has a limited validity period, it may be renewed during the rental; the renter undertakes to have a sufficient card limit.

The security deposit covers damage to the boat and its equipment, loss of or damage to inventory items, missing fuel, cleaning, late-return fees and unpaid charges. It is not a cap on liability, subject to Article B7.

After check-out, the hold is released without charge if there is no damage. Where damage or charges are recorded jointly or, failing that, under Article B8, LOCVOILIER may charge all or part of the security deposit on the basis of supporting documents (condition report, photographs, quotes or invoices). Where the cost is not known at check-out, an estimated amount may be retained, then adjusted against the invoice within 30 days, any surplus being returned to the renter.

Article B5 – Use of the boat

The renter uses the boat with due care, in accordance with its pleasure-boat purpose, its design category and its safety equipment, and only within the sailing area stated in the agreement. Unless LOCVOILIER agrees in writing, the following are prohibited: sailing at night, leaving the agreed area, taking part in races, towing another vessel (except to assist people in danger), carrying passengers or goods for payment, subletting or lending the boat, and taking on board more people than stated in the agreement.

Smoking inside the boat is prohibited, as is bringing animals on board without prior agreement, or illegal or dangerous substances. The renter complies with the rules of ports, anchoring areas and the Calanques National Park; fines and costs resulting from an offence committed during the rental are borne by the renter.

The renter keeps watch over the boat in port and at anchor and returns it to the agreed port. Any call at another port is at the renter’s expense.

Article B6 – Fuel, consumables and cleanliness

The boat is handed over with a full fuel tank and must be returned with a full tank. Otherwise, the missing fuel is charged at the actual price of the port’s fuel station, plus a flat fee of €50 for the refuelling service.

Consumables (gas, routine cleaning products) needed during the rental are borne by the renter. The boat is returned clean and tidy, with bins emptied; otherwise, a cleaning fee set in the agreement may be charged.

Article B7 – Damage, incidents and breakdowns

The renter informs LOCVOILIER without delay of any damage, breakdown, grounding, collision, loss of equipment or incident, by phone or WhatsApp, and confirms it in writing. No repair may be carried out without LOCVOILIER’s agreement, except in an emergency affecting safety; authorised repairs are refunded against invoice.

In the event of a loss covered by the boat’s insurance, the renter’s financial liability is limited to the excess stated in the agreement. This limit does not apply in the event of intentional or gross misconduct, sailing outside the agreed area or in conditions prohibited by Article B5, handling by an unqualified or undeclared person, or under the influence of alcohol or drugs; the renter is then liable for the full loss.

If a breakdown not attributable to the renter immobilises the boat, LOCVOILIER endeavours to remedy it as soon as possible or to offer an equivalent boat. Failing that, the renter is refunded pro rata for the time the boat is out of use, without prejudice to the renter’s rights in the event of fault by LOCVOILIER.

Article B8 – Return (check-out) and late return

The boat is returned at the port and time stated in the agreement. Check-out consists of a joint return condition and inventory report, signed by both parties and supplemented by time-stamped photographs. If the renter does not attend check-out or refuses to sign, the report is drawn up by LOCVOILIER, with photographs, and sent to the renter without delay; it is binding unless the renter provides evidence to the contrary within 48 hours.

Late return. A 30-minute grace period applies. Beyond that, any delay gives rise to a fee equal to 15% of the daily rental price per hour of delay begun, capped at the price of one rental day per 24-hour period of delay. In addition, the costs caused by the impossibility of handing the boat over to the next renter are reimbursed against receipts.

No fee is due where the delay results from a safety reason (weather, damage, assisting a person in danger) reported to LOCVOILIER before the return time. Without news from the renter more than 2 hours after the scheduled return time, LOCVOILIER may alert the maritime rescue services (CROSS).

Article B9 – Weather during the rental

In a bareboat rental, the skipper in command assesses sailing conditions under their own responsibility and refrains from setting sail where safety so requires. LOCVOILIER may prohibit departure where forecast conditions exceed the capabilities of the boat or crew, or when a special weather bulletin (BMS) is in force.

Days on which LOCVOILIER prohibits departure are postponed, subject to availability, or refunded pro rata. The renter’s decision not to sail, where departure has not been prohibited by LOCVOILIER, gives rise to no refund.

Article B10 – Rental with a skipper

Where the rental includes a professional skipper, the skipper is in command: they have authority on board, handle the boat and alone decide on sailing and safety matters. The skippering service may be the subject of a separate agreement with LOCVOILIER’s partner skippering provider, whose price is shown in the quote. Part II-G applies to the skipper and, where applicable, to the other crew members.

For rentals of several days, provisioning and meals for the skipper are borne by the renter or charged at a flat rate according to the quote; the skipper has a berth on board and rest periods compatible with safety. The security deposit may be reduced or waived in the agreement; the renter remains liable for damage caused by the guests.

The rules on board in Article A5 apply.

Article B11 – Cancellation scale (rentals)

For rentals of less than 3 days, the scale in Article A2 applies. For rentals of 3 days or more, unless otherwise agreed: the 50% deposit is due at booking and the balance no later than 30 days before departure; if the renter cancels:

  • more than 60 days before departure: full refund of the amounts paid, less any payment fees not returned;
  • 60 to 30 days before departure: 50% of the total price remains due to LOCVOILIER;
  • less than 30 days before departure, or no-show: 100% of the total price remains due to LOCVOILIER.

If LOCVOILIER manages to re-rent the boat for the same period, the amounts received from that re-rental are deducted from the amounts owed by the renter, less the costs incurred.

Part II-C – Yacht delivery

Article C1 – Purpose and price

Yacht delivery consists of sailing the Client’s boat from an agreed port of departure to an agreed port of arrival, with a professional skipper and, where necessary, a crew member. The price is set in the quote, per nautical mile covered or per day; the arrival date given is an estimate.

Unless otherwise stated in the quote, the following are charged in addition, at cost and against receipts: fuel, port and call charges, crew provisioning (flat rate per day and per person shown in the quote), the skipper’s travel to the port of departure and return from the port of arrival.

Article C2 – Client’s obligations

The Client declares that they own the boat or are duly authorised by its owner. The Client provides a seaworthy, well-maintained boat, fitted with up-to-date statutory safety equipment for the planned passage, together with its registration documents and a certificate of insurance covering the boat during the delivery with a professional skipper. The Client reports any known defect in writing.

If the boat is not ready when the skipper arrives (maintenance, provisioning, technical and safety checks), a preparation day is charged at the rate set in the quote.

Article C3 – Departure, weather and conduct of the delivery

The skipper chooses the weather window, route and ports of call, and may postpone departure, change course or interrupt the delivery where safety so requires. The skipper may refuse to set sail if the boat or its equipment does not offer the necessary safety guarantees; the costs incurred then remain due.

Delays due to the weather, to damage not attributable to the skipper, to a decision of the authorities or to force majeure do not constitute a failure to perform. Waiting days are charged at the daily rate set in the quote.

A condition report of the boat, with time-stamped photographs, is drawn up at departure and on arrival. The logbook and the navigation track are available to the Client.

Article C4 – Liability

The skipper is bound by an obligation of means: they handle the boat with the care and diligence of a professional. The boat remains in the custody and under the insurance of its owner. LOCVOILIER is not liable for damage resulting from the condition of the boat, its wear, a hidden defect or a lack of maintenance or equipment, nor for the consequences of perils of the sea. Its liability may only be incurred in the event of proven fault by the skipper.

Article C5 – Payment

Unless otherwise agreed, a deposit of 50% of the estimated price is due when ordering. The balance and costs at cost are invoiced on arrival, against receipts, and are payable on receipt of the invoice. Handing over the keys and documents at the port of arrival may be subject to payment of the balance.

Article C6 – Cancellation (yacht delivery)

If the Client cancels: more than 15 days before the scheduled departure date, the deposit is refunded, less costs already incurred (travel tickets, bookings); from 15 days to 3 days before departure, one day of skippering at the rate in the quote remains due, in addition to the costs incurred; less than 3 days before departure, or if the skipper has already travelled, 50% of the estimated price remains due, in addition to the costs incurred.

Part II-D – Sea transfers

Article D1 – Purpose

A sea transfer consists of carrying passengers and their luggage between two agreed points (port, beach, anchorage, cruise ship), on board a boat authorised to carry passengers, handled by a professional skipper, on the date and at the time stated in the confirmation.

Article D2 – Times and check-in

Passengers must be at the boarding point 15 minutes before the scheduled time, with their travel documents where applicable. After 15 minutes of delay without news, the transfer may be treated as not used by the Client, without refund. Arrival times are indicative.

Where the transfer is linked to a time constraint (cruise ship, flight, train), the Client reports it in writing when booking so that LOCVOILIER can plan a suitable margin; Article 10 applies.

Article D3 – Passengers and luggage

The number of passengers may not exceed that stated in the confirmation or the boat’s authorised capacity. Accepted luggage is that declared when booking; bulky or additional luggage and animals must be agreed in advance. Valuables remain in the care of their owners.

Passengers comply with the skipper’s safety instructions; minors travel under the responsibility of the adults accompanying them.

Article D4 – Weather and safety

The skipper may postpone a transfer, change the landing point or cancel it where safety so requires. If LOCVOILIER cancels, the Client chooses between a free postponement and a full refund of the transfer not performed. LOCVOILIER endeavours, where possible, to offer an alternative solution.

Article D5 – Cancellation (transfers)

If the Client cancels: more than 7 days before the transfer, full refund, less any payment fees not returned; from 7 days to 48 hours before, 50% of the price remains due; less than 48 hours before, or no-show, 100% of the price remains due.

Part II-E – Sale of products and gift vouchers

Article E1 – Scope and products

This Part applies to sales of products (in particular clothing, accessories, fine food products, wines and drinks) and gift vouchers made by LOCVOILIER on www.locvoilier.com (distance selling) or in person (at the port, on board, at events).

The main characteristics of each product, its price including all taxes and, for distance sales, delivery charges and times are shown before the order. Offers are valid while stocks last; if a product turns out to be unavailable after the order, the Client is informed and refunded no later than 14 days after payment.

Article E2 – Order and payment

On the website, the Client selects the products, checks the order summary (products, quantities, prices, delivery charges) and can correct any error before validating it. The Client accepts these Terms by ticking the box provided, then confirms the order with the “Order with obligation to pay” button. A confirmation setting out the order details and these Terms is sent by email.

By way of derogation from Article 5, the price of products and gift vouchers is payable in full when ordering. LOCVOILIER may refuse an abnormal order or one placed in bad faith, in particular where a previous payment dispute remains unresolved.

Article E3 – Alcoholic drinks

The sale of alcoholic drinks to minors is prohibited (article L3342-1 of the French Public Health Code). By ordering such drinks, the Client declares that they are of legal age; proof of identity may be requested on handover or delivery, which is refused if none is provided. Alcohol abuse is dangerous for your health; drink responsibly.

Article E4 – Delivery and collection

Products are delivered to the address given by the Client, within the area and time announced when ordering, or collected at the port as agreed. If no time is stated, delivery takes place no later than 30 days after the order. If this is exceeded, the Client may, after requesting LOCVOILIER to deliver within a reasonable additional period that has not been met, terminate the contract and be refunded (articles L216-1 et seq. of the French Consumer Code).

The risk of loss or damage passes to a consumer Client when they, or a third party designated by them, take physical possession of the products. The Client is advised to check the parcel on delivery and to report any anomaly in writing to LOCVOILIER as soon as possible, with photographs.

Article E5 – Right of withdrawal (distance sales)

For products bought at a distance, a consumer Client has 14 days from receipt of the product to exercise the right of withdrawal, without giving reasons, by an unequivocal statement (email to contact@locvoilier.com or the model form in Article 17). The Client returns the product no later than 14 days after communicating the decision; return costs are borne by the Client. The Client is only liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

LOCVOILIER refunds all sums paid, including standard delivery charges, no later than 14 days after being informed of the withdrawal, using the payment method used; it may withhold the refund until it has received the product back or proof of its dispatch.

Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to the Client’s specifications or clearly personalised, to products liable to deteriorate or expire rapidly (fresh food), or to products unsealed after delivery that cannot be returned for health protection or hygiene reasons. Purchases made in person (at the port, on board, at events) carry no right of withdrawal.

Article E6 – Statutory guarantees

Every product sold to a consumer Client benefits, free of charge and independently of any commercial guarantee, from the statutory guarantee of conformity (2 years from delivery) and the guarantee against hidden defects (2 years from discovery of the defect). These Terms can neither limit nor exclude them.

How to make a claim: the Client writes to contact@locvoilier.com, quoting the order number, describing the defect and attaching photographs. LOCVOILIER replies within 7 days with the proposed solution and, if a return is needed, the shipping arrangements; return costs for a non-conforming product are borne by LOCVOILIER. Repair or replacement takes place no later than 30 days after the request.

The regulatory information on these guarantees (French decree no. 2022-946 of 29 June 2022) is reproduced in the box below; only the French wording is authoritative.

Statutory guarantee of conformity and guarantee against hidden defects – regulatory information

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the planned supply period.

The statutory guarantee of conformity entails an obligation for the professional to provide, where applicable, all updates necessary to keep the goods in conformity.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° the professional refuses to repair or replace the goods;
2° the repair or replacement takes place after thirty days;
3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer is then not required to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

The rights above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Article E7 – Gift vouchers

A gift voucher entitles the holder to the service or amount stated on it. It is valid for 12 months from purchase, unless a different period is stated on the voucher, which shows its expiry date. It may be given to a third party (the “Beneficiary”).

The Beneficiary books a date with LOCVOILIER quoting the voucher number, subject to availability; early booking is advised as availability is limited in high season. Once the date is booked, the conditions of the activity concerned apply, including its cancellation scale. If LOCVOILIER cancels for weather or safety reasons (Article 8), the Beneficiary chooses a new date and the voucher’s validity is extended as necessary.

A gift voucher is neither refundable nor exchangeable for cash, subject to the right of withdrawal below. Any price difference (another service, additional passengers, options) is paid when booking; where the chosen service costs less, the balance remains usable during the voucher’s validity. On written request made before expiry, the voucher’s validity may be extended once, by 6 months. A voucher unused at expiry can no longer be used or refunded.

A lost or stolen voucher is replaced only on proof of purchase and if it has not already been used. A consumer who bought a gift voucher at a distance may withdraw within 14 days of purchase, provided the voucher has not been used; the refund is made to the purchaser.

Part II-F – Catering and drinks

Article F1 – How catering is provided

Catering and drinks may be: (a) prepared and served by LOCVOILIER; (b) ordered by LOCVOILIER from a partner caterer or supplier and invoiced to the Client with the service; (c) ordered directly by the Client from a caterer of their choice. The quote states which option applies.

In cases (a) and (b), LOCVOILIER is responsible towards the Client for the proper performance of the catering service (Article 1). In case (c), the contract is made directly between the Client and the caterer, who is solely responsible for it; LOCVOILIER merely allows the meals to be taken on board at the time and place agreed with it, and may charge a service fee stated in the quote.

Article F2 – Menus and number of guests

The menu and number of guests are finalised no later than 7 days before the service, or at booking if made later. After this deadline, changes are accepted subject to feasibility; if the number of guests decreases, the confirmed number remains chargeable.

Fresh produce depends on the season and on supplies. If unavailable, a product may be replaced by one of equivalent quality and value, the Client being informed where possible.

Article F3 – Allergies and dietary requirements

The Client notifies in writing, no later than when confirming the menu, any allergy, intolerance or dietary requirement of the guests. Information on the presence of the 14 regulated allergens (Regulation (EU) No 1169/2011) is provided on request. As meals are prepared in kitchens where these allergens are handled, the total absence of traces cannot be guaranteed; LOCVOILIER may decline, before confirmation, a diet it cannot safely provide.

Failing such notification, LOCVOILIER cannot be held liable for consequences related to the composition of the food served.

Article F4 – Hygiene and food brought by the Client

Meals are stored and served in compliance with the cold chain and applicable hygiene rules; they are intended to be eaten on board during the service. Leftovers taken away by the Client are at the Client’s sole risk.

The Client may bring their own food or drinks on board with LOCVOILIER’s prior agreement and remains responsible for their quality and storage. A corkage or service fee may be provided for in the quote.

Article F5 – Alcoholic drinks

Alcoholic drinks are served only to adults (article L3342-1 of the French Public Health Code); proof of identity may be requested. The skipper may refuse to serve a person who is clearly intoxicated and limit alcohol consumption for safety reasons, especially before swimming. Bottles and à la carte extras are served at the price given before they are ordered (Article 4). Alcohol abuse is dangerous for your health; drink responsibly.

Article F6 – Cancellation (catering)

Catering follows the cancellation scale of the activity to which it relates. Where it is ordered on its own, without any service at sea: more than 7 days before the scheduled date, full refund, less any payment fees not returned; from 7 days to 72 hours before, 50% of the price remains due; less than 72 hours before, 100% of the price remains due.

If LOCVOILIER cancels for weather or safety reasons (Article 8), catering not consumed is refunded or, at the Client’s choice, the meals already prepared are handed over to the Client.

Part II-G – Provision of seagoing staff

Article G1 – Purpose and nature of the service

LOCVOILIER provides the Client, for an assignment defined in the quote (date, duration, boat, sailing area, programme), with qualified seagoing staff: professional skipper, deckhand, host, onboard cook. The assignment may take place on a boat rented from LOCVOILIER or on the Client’s own boat.

This is a service: crew members are independent professionals selected by LOCVOILIER, which organises the assignment and remains the Client’s sole point of contact and the party responsible towards the Client (Article 1). On board, the crew is under the captain’s authority. Crew members are not subordinate to the Client, who expresses their wishes (programme, times, meals) to the skipper or to LOCVOILIER.

Article G2 – Qualifications and replacement

Each crew member holds the certificates required by regulations for their duties and for the boat concerned, in particular: for the skipper, an appropriate professional command certificate (for example capitaine 200); for deckhands and onboard staff, the basic safety training certificate (CFBS); for all, a valid medical fitness certificate for seafaring. Supporting documents are provided to the Client on request.

If a crew member is unavailable, LOCVOILIER replaces them with a person of equivalent qualification. Failing this, sums paid for the service not performed are refunded and, save in case of force majeure, the last paragraph of Article 7 applies.

Article G3 – Captain’s authority and duties

The skipper is the captain of the boat: they have authority on board and alone decide on departure, route, anchoring, interruption of navigation and any safety measure, including where the boat belongs to the Client. The Client and guests follow the skipper’s instructions; Article A5 applies.

Each crew member performs only the duties provided for in the quote. Any additional task (table service, cabin housekeeping, guarding the boat in port) must be included in it or agreed in advance.

Article G4 – Working time, rest and expenses

The duration of the assignment and working hours are set in the quote. Staff enjoy the rest periods required by regulations and needed for safety; the skipper may adapt the programme accordingly. Hours worked beyond the programme at the Client’s request are charged at the hourly rate stated in the quote.

For assignments of several days, the Client provides the staff with meals and a suitable berth on board, separate from the guests where the boat allows, or pays the flat rate stated in the quote. Unless otherwise stated, the staff’s travel costs to the place of embarkation and from the place of disembarkation are charged in addition, at cost. Tips are not included and are at the Client’s discretion.

Article G5 – Assignments on the Client’s boat

Where staff embark on the Client’s boat, the Client warrants that the boat is seaworthy, maintained, fitted with the required safety equipment and papers, and insured for navigation with a professional crew on board, and provides evidence on request. The Client warrants that the intended use complies with regulations, in particular that a pleasure boat is not used to carry fare-paying passengers.

The skipper may refuse to sail or interrupt navigation if the boat or its equipment does not offer the necessary safety guarantees; the service then remains payable. The boat remains in the custody and under the responsibility of its owner, subject to proven fault by the staff.

Article G6 – Liability

Crew members are under an obligation of means and perform their duties with professional diligence. LOCVOILIER is liable towards the Client for damage caused by proven fault of a crew member in the performance of their duties; it is not liable for damage resulting from the condition of the boat, wear and tear, a hidden defect, lack of maintenance or equipment, the acts of the Client or guests, or perils of the sea.

Towards a business Client, LOCVOILIER’s liability is limited, save for gross negligence or wilful misconduct, to the price of the service; the business Client also undertakes not to hire directly, for comparable services, any crew member introduced by LOCVOILIER for 12 months after the end of the assignment, without LOCVOILIER’s written agreement.

Article G7 – Cancellation (seagoing staff)

Where the provision of staff is linked to a boat trip or rental, it follows the cancellation scale of that activity. Where ordered on its own, the scale in Article A2 applies to assignments of less than 3 days and that in Article B11 to assignments of 3 days or more; costs already incurred (travel tickets, bookings) remain payable in all cases.

For an assignment on the Client’s boat, days during which the staff remain available on board or in port awaiting safe sailing conditions are payable at the daily rate in the quote; the second paragraph of Article 8 applies only to a cancellation decided before the staff have travelled.

Part II-H – Charter management and technical management of boats

Article H1 – Management agreement and application of these Terms

The charter management of a boat entrusted by its owner (the “Owner”) is governed by an individual charter management agreement made with each Owner. That agreement prevails over these Terms; Part I and this Part apply to any matter it does not cover.

The management agreement specifies in particular: the boat, its category and operating regime (pleasure or commercial use), the authorised activities (rental with or without a skipper, boat trips), LOCVOILIER’s remuneration, the terms for paying over revenue, the technical services included, the spending threshold, the periods reserved for the Owner, the term and termination conditions.

Article H2 – Rentals of managed boats

Rentals and boat trips on the managed boat are concluded with customers under these Terms (Parts II-A and II-B), which the Owner accepts as the framework for customer relations. LOCVOILIER markets the boat, applies the rates agreed in the management agreement, selects renters, checks skippers’ qualifications, carries out check-ins and check-outs and manages security deposits.

Sums withheld from a security deposit or recovered from a renter for damage to the boat are allocated to its repair. LOCVOILIER guarantees neither an occupancy rate nor a level of revenue, unless expressly undertaken in the management agreement.

Article H3 – Periods reserved for the Owner

The Owner books personal-use periods in the schedule within the time limits set in the management agreement; rentals already confirmed take priority. If the Owner withdraws the boat from a period already rented or makes it unavailable through their own act, the Owner bears the refunds and compensation due to customers (Article 7) and the remuneration LOCVOILIER would have earned on that rental.

Article H4 – Insurance, compliance and claims

Throughout the agreement, the Owner maintains insurance for the boat (hull and third-party liability) covering the intended operation (rental with or without a skipper, boat trips) and mentioning LOCVOILIER’s activity, and provides evidence each year. The Owner ensures the boat’s regulatory compliance with its operating regime (navigation papers, safety equipment and, for a boat in commercial use, the certificates and surveys required by Division 241 of the regulation annexed to the French order of 23 November 1987) and provides the corresponding documents.

The Owner accepts that a renter’s financial liability, in the event of a claim covered by insurance, is limited to the excess stated in the rental agreement (Article B7). LOCVOILIER reports claims arising during a rental, assists the Owner in handling them and provides the evidence (condition reports, photographs, logbook).

Article H5 – Technical management: services

Where the management agreement so provides, LOCVOILIER handles the boat’s technical management: routine maintenance and preparation between rentals, cleaning, supervision in port, monitoring of regulatory surveys and deadlines, commissioning and winterisation, fault diagnosis, ordering parts and coordinating contractors working on the boat. Services included in the management fee are defined in the agreement; others are invoiced under Article H7.

Article H6 – Quotes, Owner’s approval and emergencies

Any expense or work above the threshold set in the management agreement (failing which, €300 including tax per intervention) requires the Owner’s prior written approval, by email or WhatsApp, on the basis of a quote. Without approval, it is not undertaken; if this compromises the boat’s safety or compliance, LOCVOILIER may withdraw the boat from rental until it is carried out, without compensation to the Owner.

In an emergency threatening the boat, people or third parties (water ingress, failed mooring, damage during a rental, risk of fire or pollution), LOCVOILIER may take the strictly necessary protective measures without prior approval; it informs the Owner without delay and justifies the cost.

Article H7 – Rates for technical work

Work not included is invoiced at the hourly labour rate set in the management agreement; parts, products and third-party work are recharged at cost against receipts, plus any handling fee provided for in the agreement. Replaced parts are kept available to the Owner for 30 days and then disposed of, unless otherwise requested.

Article H8 – Liability (technical management)

LOCVOILIER is under an obligation of means and performs its services with professional diligence. It is not liable for normal wear and tear, hidden defects, defects existing before management began, or the consequences of work refused or postponed by the Owner. Manufacturers’ and contractors’ warranties are passed on to the Owner. A contractor chosen by the Owner contracts directly with the Owner and is solely responsible for its work.

Outside rental periods and LOCVOILIER’s interventions, the boat remains in the Owner’s custody, subject to the supervision obligations set out in the management agreement.

Article H9 – Statements, payment and set-off

Revenue, LOCVOILIER’s remuneration and expenses are set out in a management statement sent to the Owner at the frequency set in the agreement. Where the agreement so provides, technical management invoices are set off against revenue to be paid over; otherwise they are payable within 30 days of issue.

In the event of late payment, Article 13 applies to a business Owner; for a consumer Owner, sums due bear interest at the statutory rate from a formal notice. After a formal notice has remained unanswered for 15 days, LOCVOILIER may suspend its services, except for essential safety measures, and exercise the right of retention under article 2286 of the French Civil Code over the boat and its equipment until payment of sums due for their maintenance and repair.

Article H10 – Term and end of the management agreement

The term and termination conditions are set in the management agreement. On its expiry, rentals already confirmed are performed, unless the Owner bears the compensation of customers under Article 7; a final management statement settles the accounts between the parties, and the boat, its papers, keys and equipment are returned to the Owner, after payment of sums due, following a joint condition report.

Article H11 – Right of withdrawal of a consumer Owner

Where the Owner acts as a consumer and the management agreement is concluded at a distance or off-premises, the Owner has 14 days from its conclusion to withdraw without giving reasons, using the form in Article 17 or any unequivocal statement. If the Owner expressly requests that performance begin before the end of this period, the Owner remains liable, in the event of withdrawal, for the amount corresponding to the services provided up to that decision (article L221-25 of the French Consumer Code).

Part II-I – À la carte services for boat owners

Article I1 – Purpose and service area

LOCVOILIER offers boat owners, in particular those who rent out their boat on a self-managed basis through the locvoilier.com platform, one-off services: check-in and check-out (handover of the boat to the renter and return, condition report, inventory, photographs, security deposit check), end-of-rental cleaning, hull and underwater maintenance (polishing, antifouling), provision of seagoing staff (professional skipper, host, onboard cook, deckhand) and, on quotation, any other preparation or maintenance work.

These services are performed in the ports between L’Estaque and Saint-Cyr-sur-Mer, in particular Port Corbières, L’Estaque, Saumaty, the Vieux-Port, Frioul, Pointe-Rouge, La Madrague de Montredon, Les Goudes, Cassis, La Ciotat and Saint-Cyr-sur-Mer. Outside this area, they are quoted separately, including travel costs.

Article I2 – Order, price and payment

Services are ordered in writing (owner area, email or WhatsApp) no later than 48 hours before the intervention, subject to availability, and confirmed in writing by LOCVOILIER.

The applicable prices are those of the rate card published on the Louer son bateau page on the day of the order, or those of the quote. Check-in and check-out are charged per intervention. Cleaning, polishing and antifouling are charged according to the type and length of the boat, lifting the boat out of the water (handling and storage ashore) being charged in addition, at the public rates of the port’s lifting operator; surcharges apply for each task left undone on return (plancha, washing-up, rubbish, linen), and exceptional dirt is quoted separately. Seagoing staff are charged under Part II-G.

The price is payable on ordering or on receipt of the invoice. Where the rental is paid through the platform, it may, with the owner’s agreement, be deducted from the amounts paid out to the owner.

Article I3 – Performance and liability

LOCVOILIER acts on behalf of the owner, who remains the lessor of the boat and the renter’s contracting party. Check-in and check-out are carried out using the condition report and inventory provided or approved by the owner; LOCVOILIER records the condition of the boat jointly with the renter, notes any discrepancies and damage, and sends everything to the owner with the photographs.

LOCVOILIER is under an obligation of means. It guarantees neither the compliance of the boat nor the performance of the owner’s commitments towards the renter. If it finds an obvious defect that compromises safety, it may refuse to hand over the boat and informs the owner immediately.

The owner ensures access to the boat at the agreed times (keys, codes, berth). A trip made pointless by the owner or the renter is charged as a completed intervention.

Article I4 – Cancellation (à la carte services)

The owner may cancel a service free of charge up to 48 hours before the intervention. Less than 48 hours before, 50% of the price remains due; where the provider has already travelled, the full price is due. Cancellation of seagoing staff is governed by Article G7.
