Part I – The platform and its users

Article 1 – Platform operator

The platform available on the locvoilier.com website (the “Platform”) is operated by NAVI, a French simplified joint-stock company (société par actions simplifiée) with a share capital of €1,000, registered with the Marseille Trade and Companies Register under number 922 478 961 (SIRET 922 478 961 00019), whose registered office is at 201 rue Paradis, 13006 Marseille, France, and which operates the LOCVOILIER brand from its nautical base at the Port Corbières harbour office, Quai de la Lave, 13016 Marseille, France (“LOCVOILIER”). Contact: contact@locvoilier.com – +33 7 44 90 91 83.

On the Platform, LOCVOILIER acts as an online platform operator within the meaning of Article L111-7 of the French Consumer Code: it puts boat owners in touch with people who wish to rent their boats.

Article 2 – Definitions

  • Owner: an individual or legal entity, private or professional, who offers their boat for rent on the Platform and has the right to rent it out.
  • Renter: a person who books a boat on the Platform; for a bareboat rental, the Renter appoints a skipper in command.
  • Listing: the boat’s page published on the Platform (description, photographs, equipment, capacity, port, rates, calendar, security deposit, specific conditions).
  • Self-managed: the formula in which the Owner manages their rentals themselves; it is governed by these terms of use (the “Terms of Use”).
  • Charter management: the formula in which LOCVOILIER markets and operates the boat on the Owner’s behalf; it is governed by a management agreement and by Part II-H of the general terms and conditions of sale (the “Terms of Sale”), not by these Terms of Use.
  • Sailing CV: the record of experience and qualifications of the skipper in command, validated by LOCVOILIER.
  • User: any Owner or Renter.

Article 3 – Acceptance and amendment

Using the Platform to publish a Listing or book a boat implies acceptance of these Terms of Use, which are available at any time on locvoilier.com and downloadable as a PDF.

LOCVOILIER may amend these Terms of Use. Users are informed of any amendment by email at least 15 days before it takes effect; an Owner who refuses it may withdraw their Listings free of charge before that date. Bookings already confirmed remain governed by the Terms of Use in force on the day of their confirmation.

Article 4 – Access and user account

The Platform is reserved for adults with full legal capacity. Users provide accurate, up-to-date information and update it without delay. They are responsible for keeping their login details confidential and for any use of their account.

Until the online area opens, steps are taken through the website forms, by email or by WhatsApp; the information provided is carried over to the User’s account when it opens.

The Owner states whether they act as a private individual or as a professional. This status is displayed on each Listing. A Renter who rents from a private Owner is informed that they do not benefit from the consumer-law rights applicable to contracts with a professional, in particular consumer mediation.

Article 5 – Role of LOCVOILIER

In the self-managed formula, LOCVOILIER is neither the lessor, nor the owner, nor the manager of the boat. The rental contract is concluded directly between the Owner and the Renter, on the basis of the model contract provided by the Platform, which the parties complete and sign.

LOCVOILIER selects the boats admitted to the Platform, checks the documents provided by the Owner, reviews and validates sailing CVs, provides the booking, contract, payment, security deposit and rating tools, and remains reachable during the rental to help the parties. It is under an obligation of means.

LOCVOILIER guarantees neither the accuracy of Users’ statements, nor the condition or compliance of the boat, nor the performance of the rental contract. Services that LOCVOILIER sells itself (à la carte services, seagoing staff, boats from its own fleet or under charter management) are governed by the Terms of Sale.

Part II – Users’ commitments

Article 6 – Admission of the boat and Listing

Before publication, the Owner gives LOCVOILIER the boat’s details and the following documents: proof of ownership or authorisation to rent, registration or navigation documents, an insurance certificate covering rental to third parties and, where applicable, berth documents. LOCVOILIER may ask to inspect the boat and may refuse a Listing without giving reasons.

The Listing is honest and complete: recent photographs of the actual boat, equipment actually on board and in working order, authorised capacity, departure port, rates, security deposit and specific conditions. The Owner keeps the calendar up to date; a period shown as available must be bookable.

Article 7 – Owner’s obligations

For each rental, the Owner undertakes:

  • Compliance: to rent out a seaworthy boat, carrying the safety equipment required for the intended navigation area (French Division 240), with up-to-date navigation documents and inspections, and insurance covering rental to third parties in force throughout the rental.
  • Relationship with the Renter: to answer each request within 48 hours, honour accepted bookings and remain reachable throughout the rental.
  • Preparation and cleanliness: to hand over a clean, prepared boat, with the tanks and inventory set out in the Listing.
  • Check-in and check-out: to carry out, personally or through an appointed person, the handover and return of the boat, the joint condition report, the inventory and the check of the skipper in command; these operations may be entrusted to LOCVOILIER as à la carte services (Article 15).
  • Availability: to be present or represented at the agreed departure and return times.
  • Regulations: a crewed rental or a skippered trip is subject to professional regulations (commercial-use vessel, professional crew qualifications). The Owner may offer them only if they meet those conditions themselves, or by using LOCVOILIER’s seagoing staff.
  • Tax and social obligations: to declare the income from their rentals as set out in Article 21.

Article 8 – Renter’s obligations

The Renter undertakes:

  • to provide accurate information about themselves, the skipper in command and the people on board;
  • for a bareboat rental, to present a validated sailing CV and a skipper in command who is an adult, holds the qualifications required for the boat, and is present at check-in and throughout the rental;
  • to use the boat with due care, within the authorised navigation area and capacity, in compliance with maritime, port and environmental regulations, in particular in the Calanques National Park;
  • not to set sail when the weather or the condition of the crew so requires;
  • to return the boat on time, in the agreed state of cleanliness and with the agreed tanks, and to report any incident or damage without delay.

Article 9 – Sailing CV

Any bareboat rental requires a sailing CV validated by LOCVOILIER. LOCVOILIER reviews it within 48 hours and may ask for details, suggest a more suitable boat, require a skipper for all or part of the rental, or refuse validation. Once validated, the sailing CV is kept and applies to subsequent rentals, provided the Renter keeps it up to date.

Validation of the sailing CV confirms that the record presented is consistent with the boat requested; it neither relieves the skipper in command of their responsibility nor replaces the Owner’s own assessment at check-in. An Owner who finds, on reasoned grounds, that the skipper’s ability is insufficient for safety may refuse to hand over the boat; the Renter is then refunded the amounts paid, unless they made a false statement.

Part III – Booking, price and payment

Article 10 – Booking and rental contract

The Renter sends a booking request for given dates and a given formula. The Owner accepts or declines it within 48 hours, after reading the sailing CV; failing a reply, the request lapses and nothing is due.

The booking is firm once the Owner has accepted it and the Renter has paid the amount requested. The rental contract, drawn up on the Platform’s model, is then signed by both parties; it specifies the boat, dates, price, security deposit, skipper in command and the specific conditions of the Listing.

Article 11 – Price, commission and service fee

The rental price is set freely by the Owner and displayed including all taxes.

In return for the matching service, LOCVOILIER charges:

  • the Owner, a commission of 12% including tax of the rental price, excluding options, à la carte services and the security deposit, deducted from the amounts paid out to the Owner;
  • the Renter, a service fee of 5% including tax of the rental price, calculated on the same basis and included in the total price displayed from the Listing onwards.

The service fee is refunded to the Renter where the rental is cancelled by the Owner or by LOCVOILIER, or where the Renter cancels within the period that entitles them to a refund of all amounts paid; it is retained in all other cases. In the event of cancellation, the Owner’s commission applies only to the amounts the Owner keeps.

LOCVOILIER invoices the Owner for its commission and the Renter for its service fee. Where the Owner is a professional, the Owner issues the rental invoice to the Renter.

Article 12 – Payment and payout

Payments are made by bank card or bank transfer on the Platform’s secure payment page, operated by Stripe, a licensed payment service provider: funds are collected and paid out by Stripe on the Owner’s behalf. LOCVOILIER never has access to card data.

Unless the Listing provides otherwise, a 50% deposit is paid on booking and the balance no later than 30 days before departure (7 days for a rental of less than 3 days); for later bookings, the full amount is paid on booking.

The amounts due to the Owner, less the commission and, where applicable, the price of any à la carte services the Owner ordered, are paid into the Owner’s bank account within 7 days of the start of the rental.

Article 13 – Security deposit

The security deposit set in the Listing is provided by the Renter no later than check-in, as a card pre-authorisation without debit on the Platform’s secure page. As a card authorisation has a limited validity, it may be renewed during the rental and until the end of the claim period below; the Renter keeps a sufficient card limit.

It is released after check-out if there is no damage. In the event of damage, loss, missing fuel, cleaning not done or late return recorded in the return condition report, the Owner may request a debit, with supporting evidence (condition report, photographs, quotes or invoices), within 7 days of check-out. The Renter is informed of the request and may submit observations; LOCVOILIER executes the debit on the basis of the evidence, without ruling on liability, which remains a matter for the parties and, where applicable, their insurers.

Article 14 – Cancellation and weather

Unless the Listing provides more favourable conditions, cancellation by the Renter follows the rental cancellation scale of the Terms of Sale (Articles A2 and B11), applied for the Owner’s benefit: the amounts that scale leaves due are due to the Owner, and the deduction provided for in the event of re-letting applies where the Owner re-lets the boat for the same period.

An Owner who cancels a confirmed booking refunds the Renter in full, service fee included. LOCVOILIER may charge the Owner the payment costs incurred and suspend their Listings; repeated cancellations lead to exclusion from the Platform.

The skipper in command does not set sail when safety so requires. Where the Owner prohibits departure because of a special weather bulletin or conditions exceeding the capabilities of the boat or crew, the days concerned are, at the Renter’s choice, postponed subject to availability or refunded pro rata within 14 days. A Renter’s decision not to sail when departure is not prohibited gives rise to no refund.

Article 15 – À la carte services

The Owner may entrust LOCVOILIER with check-in, check-out, end-of-rental cleaning or the provision of seagoing staff (professional skipper, deckhand, host, onboard cook), in the ports between L’Estaque and Saint-Cyr-sur-Mer. These services are sold by LOCVOILIER to the Owner at the prices published on the Louer son bateau page and are governed by Part II-I of the Terms of Sale.

Part IV – Ratings, ranking and disputes

Article 16 – Mutual ratings and reviews

After each rental made through the Platform, the Renter rates the Owner and the Owner rates the Renter, from 1 to 5 stars, with an optional comment. The Renter assesses the accuracy of the Listing, the condition and cleanliness of the boat, and the Owner’s welcome and availability; the Owner assesses the Renter’s care of the boat, punctuality, cleanliness on return and communication.

Reviews are checked: only the Renter and the Owner of a rental completed and paid through the Platform may leave a rating, once per rental, from their account or the personal link sent to them. Ratings are submitted within 14 days of check-out. Each party rates without seeing the other’s rating: both reviews are published together, as soon as both parties have rated or, at the latest, when the period expires.

Reviews are never rewarded. They are published in chronological order, with the date of the review and the date of the rental, and kept for three years. LOCVOILIER never alters their content; it may refuse or remove a review that is abusive, defamatory, discriminatory, unrelated to the rental or contains personal data, and informs its author. Each User may reply publicly to a review concerning them and report a review by email to contact@locvoilier.com.

Ratings are taken into account by LOCVOILIER in ranking Listings and reviewing booking requests; a persistently insufficient average rating may lead to the suspension of an account.

Article 17 – Ranking of Listings

Listings are presented according to how well they match the criteria chosen by the User (boat type, formula, area and port, capacity, dates), then according to availability, the average rating of the boat and Owner, the completeness of the Listing and the date it was last updated. No Owner can pay for a better ranking.

Boats from LOCVOILIER’s own fleet and boats entrusted to it under charter management appear in the same results; they are identified by the mention “LOCVOILIER” and rented under the Terms of Sale. They receive no ranking advantage.

Article 18 – Liability of LOCVOILIER

LOCVOILIER endeavours to ensure continuous access to the Platform but cannot guarantee it, in particular during maintenance, outages or interventions by its technical providers.

LOCVOILIER is not a party to the self-managed rental contract. It is not liable for damage resulting from non-performance of that contract, the condition of the boat, a navigation accident or a User’s behaviour, unless its own fault in performing its own obligations is proven.

Article 19 – Suspension and closure of account

LOCVOILIER may suspend a Listing or an account, by a reasoned notice sent to the User before the suspension, save in an emergency, in the event of a breach of these Terms of Use, a false statement, an expired document, lack of insurance, dangerous behaviour or persistently insufficient ratings. Confirmed bookings are then performed or, where safety so requires, cancelled with a refund to the Renter.

A User may close their account at any time by email, subject to the performance of bookings in progress.

Article 20 – Disputes between Users and mediation

In the event of a disagreement between an Owner and a Renter, the parties first seek an amicable solution; at the request of either of them, LOCVOILIER may help them find one, without being bound to succeed.

For any complaint about LOCVOILIER’s own services (Platform, service fee, à la carte services), a consumer sends a written complaint to contact@locvoilier.com and may then refer the matter free of charge to the consumer mediator LOCVOILIER belongs to: CM2C, 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net. A dispute with a professional Owner falls to the mediator designated by that Owner; a dispute with a private Owner does not fall within consumer mediation.

Article 21 – Owners’ tax and social obligations

Income from renting out a boat is taxable and, depending on its amount and tax regime, may be subject to social contributions. The Owner alone is responsible for this; useful information is available on impots.gouv.fr and urssaf.fr.

Pursuant to Articles 242 bis and 1649 ter A et seq. of the French Tax Code (EU directive DAC7), LOCVOILIER informs the Owner of their obligations at each transaction, sends them before 31 January each year a summary of the amounts received in the previous year, quarter by quarter, with the commissions withheld, and transmits the required information to the tax authorities (identity, address, date of birth for an individual, tax identification number, SIREN and VAT number for a company, bank account, amounts received, commissions and number of rentals). The Owner provides this information when creating their Listing; failing that, and after two unanswered reminders, LOCVOILIER suspends payouts until it is provided and may close the account.

Article 22 – Personal data and content

Users’ data are processed by LOCVOILIER to manage accounts, Listings, bookings, payments, sailing CVs, reviews and its legal obligations, as described in the privacy policy. A User’s contact details are passed to the other party only once the booking is confirmed, for the performance of the rental.

The Owner warrants that they hold the rights to the photographs and texts in their Listing and authorises LOCVOILIER, for as long as they are published, to reproduce and adapt them on the Platform and in its communications relating to the Platform.

Article 23 – Governing law and language

These Terms of Use are governed by French law. Consumers retain the protection afforded to them by the mandatory provisions of their country of residence. Any dispute with a professional User falls within the jurisdiction of the courts of Marseille.

These Terms of Use are drawn up in French and English. In the event of any discrepancy, the French version prevails.
